Barnard Griffin Privacy Policy

Barnard Griffin, Inc. (“WINERY” or “we”) respects your individual privacy. This privacy policy documents our adherence to the highest industry standards for the protection of your personal information. The policy is effective as of 1/1/08, applies to information collected through the site www.BarnardGriffin.com, and covers the following areas:

  •     What personally identifiable information is collected by WINERY or by any third party through our site;
  •     How WINERY uses this information;
  •     With whom WINERY may share this information;
  •     What choices are available to you as a user of the site with respect to collection, use and distribution of the information;
  •     What types of security procedures are in place to protect the loss, misuse or alteration of information under our control; and
  •     How you can correct any inaccuracies in the information.


1.         Information Collection and Use

WINERY collects information on the site at two different stages. First, we collect anonymous, aggregate information (such as domain name or IP address) from all visitors to the site. This type of information is never linked to any personally identifiable information and is only used in the aggregate to generate statistical reports about the use of our site.

Second, we require the submission of certain personally identifiable information when you purchase products or use services available on the site. For example, when you order wine to be shipped to you or another person, we retain your and the recipient’s name, address, telephone number, e-mail address, and credit card or other payment information together with the details of your order, and you give us permission to share that information with third parties such as a bank or the credit card company for purposes of processing the order.  Likewise, when you sign up for our newsletter, emails, blogs, events and/or to participate in online contents, promotions or giveaways that may be offered through the Service, we will collect and retain your name, address, telephone number, e-mail address and verification of eligibility (age). If you join one or more of our wine club programs, we will collect the same kinds of information as for orders and use it to administer the program.    

2.        Personal Information of Children Under 13

WINERY complies with the requirements of the Childrens Online Privacy Protection Act (COPPA) and the FTC’s Rule interpreting COPPA (16 CFR § 512). This site is not directed to children nor do we knowingly collect any personally identifiable information from anyone under 13 years of age through this site.

3.        Use of Your Personal Information

WINERY will not use your credit card or other financial account information except to process your order.

WINERY may use personal information collected under this Privacy Policy to contact you regarding special offers or promotions that may be of interest to you. You may “opt out” of receiving such communications at any time by logging in to the Service and changing your preferences, if you are a registered user, or by following the instructions on any marketing e-mail from WINERY, or by calling our Customer Service department at 509-627-0266. In addition to e-mail, WINERY may add your name and postal address to our postal mailing list. We may make the names and postal addresses available to third parties only for purposes of shipping of non-wine products you purchased through our wine shop. If you join one or more of our wine clubs, we will use the information submitted to administer the program and we will track the purchases associated with your account. Administration of the program includes using the information to speed you through the checkout process. You may cancel your participation in the program at any time.

If you use WINERY’s feature allowing you to e-mail content from the WINERY site to a friend, the recipient will receive your name and e-mail address, but WINERY will not retain the recipient’s name and e-mail address and will not use it to send any marketing communication to the recipient.

Even if you request to opt out of receiving one or more types of marketing communications from WINERY, we may still contact you regarding orders placed by you through the WINERY site.

4.        Use of Aggregate Information

We store information that we collect through log files to create a profile of our users. Log files record internet protocol (IP) addresses, browser types, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track a customer’s movement in the aggregate, and gather broad demographic information for aggregate use. IP addresses, etc. are not linked to personally identifiable information. A profile is stored information detailing how individual customers use the site. It is used solely for internal purposes, to help us improve the experience of our customers. We may use a third party such as Google Analytics to assist us in processing and analyzing aggregated information.

5.        Disclosure of Personal Information As Required By Law

We will disclose personal information when required by law, or if we have a good-faith belief that such action is necessary to (a) comply with a current judicial proceeding, a court order or legal process served on us, (b) protect and defend our rights, or (c) protect the rights, property, and other interests of our users or others.

6.        Business Transitions

In the event WINERY goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, our customers’ personal information may be part of the assets transferred. The information transferred or shared remains subject to the promises made in any previously applicable privacy policy, unless you agree to new terms.

7.        Links

This Web site contains links to other sites. WINERY is not responsible for the privacy practices or content of these other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by our site.

8.        Security

WINERY takes commercially reasonable precautions to protect your information, including your PHI. For example, we encrypt communications through our site with 256-bit encryption, the industry standard for strong encryption. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of your information.  We maintain notification procedures as part of our information security policy, to be used in the event of a data security breach. If we are required to provide notice to you of a data security breach, the notice will be provided in electronic form.    

While we use encryption to protect sensitive information online, we also make an effort to protect your information off-line. All of our customers’ information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job (for example, our billing clerk or a customer service representative) are granted access to personally identifiable information. All employees are kept up-to-date on our security and privacy practices. Finally, the servers that store your personally identifiable information are housed in a secure environment.

 When registering for access to a secure area of the site, we will ask you to select a username and password. We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or in an unsolicited email. Also, remember to sign out of the registered site and close your browser window when you have finished your work. This is to ensure that others cannot access your personal information and correspondence when accessing your computer.

9.        Correcting, Updating, Deleting and Deactivating Personal Information<

If your personally identifiable information changes, you may contact us to correct, update or delete and deactivate our record of your personally identifiable information.

10.        Notification of Changes

If we decide to change our privacy policy, we will prominently post a notice on the main page and other pages to alert you about the change.

If the privacy policy changes materially so that we are going to use your personally identifiable information in a manner different from that stated at the time of collection, we will notify you via email and give you a choice as to whether or not we may use your information in this different manner. However, if you deleted and deactivated your account, then you will not be contacted and your personal information will not be used in this new manner. In addition, if we make any material changes in our privacy practices that affect customer information already stored in our database, we will post a prominent notice on our Web site notifying customers of the change. In some cases where we post a notice we will also email customers, who have opted to receive communications from us, notifying them of the changes in our privacy practices.
